Who is who (Deputy Commissioner (DC)

At present, Shri. Rahul Purwar IAS is the official head of Latehar District. The DC is required to be an Indian Administrative Service (IAS) Officer. DC is appointed under general supervision of the Jharkhand government.

DC is the official administrative head of the District on all matters of revenue, law and order and development functions of the district. DC is also an official link person between the district administration and various Secretaries of the Government of Jharkhand. DC is the linchpin integrating district and state government departments to ensure faster and citizen centric governance.

The Office of the Deputy Commissioner is located in the Latehar district head quarter town at Latehar. However, frequent visit to various parts of the district is part of the official function of the DC to facilitate and administrative monitoring functions.

 

BACKGROUND

In Jharkhand, the head of the district is called Deputy Commissioner (DC). In many other states, the head of the district is known as Collector and in few states; the head of the district is designated as District Magistrate. The name Collector was derived from the revenue laws and administration. Therefore, the name Collector was coined in view of collection of revenue and recovery of revenue dues. The word District Magistrate denotes the executive functional head from the point of view of maintaining law and order of the District.

Jharkhand is different even in the Bihar days before 2000, for the reason that it was/is primarily a tribal regions and the District head is named as Deputy Commissioner (DC). This system was created by the British regime to administer the tribal regions.

Above the DC, there is a Commissioner who is a heading the cluster of districts. Latehar comes under Palamau Commissionary of Jharkhand. Under the Commissioner, three districts-Palamau, Garwah and Latehar are coming under it. The Commissioner is also called Divisional Head of Jharkhand.

The word DC is quasi judicial designation. DC is the legal authority for all matters at the district level related to land, tax and tribal administration of scheduled areas, notified by the government. Commissioner is an appellant legal authority under land and tribal laws for the verdict passed by the DC.

Who is the DC of Latehar

What DC does

DC-head of revenue administration:
Deputy Commissioner is the official head of the district administration as well as the Chief Revenue Officer/ District Collector. DC is responsible for collection of revenue and other government dues recoverable as arrears of land revenue.
The DC responsible for collection of land revenues, recovery of land revenue and tax related to the district in line with various laws related to land,  revenue and tax collections of the district.


The DC is legal authority under Stamp and Registration Act, Land Reforms Act, Irrigation Act, Excise Act and Public Health Act. When executing duties with regards to revenue collection, the DC exercises quasi-judicial functions.
Thus, DC is the legal custodian and public authority of various assets, such as public land, irrigation channels, wet lands, forest and other public assets under the jurisdiction of the district.
Under the Registration Act the DC exercise the Powers of Registrar of the District and he controls and supervises the work of Registration of deeds.


DC  also deals with the Natural Calamities like draught, unseasonal rains, hailstorms, floods and fire etc.
The Deputy Commissioner holds courts and hears appeals under the revenue laws against the order of Sub Divisional Officer (Civil), passed as Additional/Assistant Collector under various land and tenancy laws.


DC is assisted by an Additional Collector at the district for dealing with revenue matters.
At the sub-divisional level, a Sub-Divisional Officer is responsible for all the matters related to revenue and tax collection 
At the Circle level the Circle Officials of blocks are assigned with the responsibility of revenue and tax collection.
Therefore, on all revenue matters, DC is legal authority of the district both on legal and administrative matters including the grievance redressal of the citizens on revenue, land and tax related matters.

DC-Executive Magistrate and head of the law and order machinery:

At the district level, DC is overall responsible for maintaining law and order of the district. Therefore, he is the executive magistrate of the district, heading the executive functions of handling law and order of the district. DC is vested with the legal power to ensure the maintenance of public order and peace in the district.

The police force in a District is, therefore, placed under the official and general control and direction of DC. The DC is responsible for protection of public against lawlessness and disorder to ensure peace and tranquility in the district.
The police force is mainly an instrument provided by law. DC can impose restriction on the movement of unlawful assembly and can also impose curfew keeping in view the situation to maintain law and order in the district.

The DC is being assisted by Superintend of Police (SP) at the district level and various police officials at the district, sub-district and local levels. He is also vested with power and authority for criminal administration of the district including management of jails.

DC-Functional head of civil administration and development of the district:

  • DC is also the official head of civil matters pertaining to the development functions of the district. He is an ex-officio chairman of various societies and agencies that are involved in the implementation of various development schemes.
    Deputy Commissioner is also the District Programme Coordinator under National Rural Employment Guarantee Act (NAREGA), heads of agencies such as District Rural Development Agency (DRDA), National Rural Health Mission Society, Micro Economic Socio Organisation (MESO), Central sponsored Social sector and welfare schemes of the district.
    In other words, DC is responsible for implementation of various anti-poverty and infrastructure development schemes of the district. He also facilitates the functions of development planning and decentralised governance including the local body governance through the elected panchayat representatives in rural and urban areas.

    DC-the functional head of tribal administration:

    • Latehar is the notified scheduled tribal district in Jharkhand and therefore it is a scheduled area. DC is the head of the schedule area administration including the implementation of Chota Nagpur Tenancy Act (CNT) and enforcement of various laws linking the scheduled tribal areas. He also conducts court proceedings under the CNT act as a court of appeal against the decisions of the authorities at the sub-divisional level. He is the custodian and official head to protect and promote the rights and entitlements of the tribes as per the rule of law.
      To carry out the tribal development works, DC is assisted by Welfare and MESO officials. DC is also responsible for evolving tribal sub-plan and implementation of the tribal plan as per their needs and cultural and social ethos of tribes. 

      Other responsibilities of DC


      DC is authorized to inspect the Offices, Courts of Sub Divisional Officers (Civil), Tehsildars, Treasuries, Sub Treasuries, Jails, Hospitals, Dispensaries, Schools, Blocks, Police Stations, Local Bodies and any other instruments or units of the district.
